Terms of Service

These terms are an agreement between you and Extra Date Night (“we”, “us”) covering your use of our website and iOS app (together, the “Service”). By creating an account or using the Service you agree to them.

Your account

You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service. You're responsible for your account and for keeping your password secure. Provide accurate information and don't impersonate anyone.

Your content

You own the content you create — plans, notes, ratings, and photos. You give us the limited license we need to store, display, and back up that content in order to run the Service (including showing it to a partner account you link). Don't upload content that's illegal, infringes someone else's rights, or that you don't have permission to share. We may remove content that violates these terms.

Community ideas

If you submit a date idea for the public catalog, you grant us a perpetual, royalty-free license to display and adapt it within the Service. We review submissions and publish at our discretion.

Acceptable use

Don't abuse the Service: no scraping, no attempting to access other users' data, no reverse engineering, no automated bulk account creation, and no using the Service to send spam or harass anyone. We may rate-limit, suspend, or terminate accounts that threaten the Service or other users.

Premium

Premium is an optional paid subscription (currently purchased on the website and billed through Stripe). Prices and features are shown at purchase. You can cancel anytime, effective at the end of the current billing period; fees already paid are non-refundable except where required by law.

Third-party venues and events

Date ideas often reference real venues and events run by third parties. We don't operate them and can't guarantee hours, prices, availability, or safety — check before you go. Your participation in any activity is at your own risk.

Disclaimers

The Service is provided “as is” without warranties of any kind, express or implied. We don't warrant that the Service will be uninterrupted or error-free, or that any date will go well — that part is up to you two.

Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or data, arising from your use of the Service. Our total liability for any claim is limited to the greater of $50 or the amount you paid us in the twelve months before the claim.

Termination

You can stop using the Service or delete your account at any time (in the iOS app under Profile → Delete account). We may suspend or terminate accounts that violate these terms. Sections that by their nature should survive termination (like limitations of liability) survive.

Changes

We may update these terms as the Service evolves. For material changes we'll update the effective date and give notice in the product or by email; continuing to use the Service after changes take effect means you accept them.

Governing law

These terms are governed by the laws of the State of Maryland, USA, without regard to conflict-of-law rules.
